Terms and Conditions
The agreement between you and Smarch when you use the website and the platform. We have written it to be read — if anything is unclear, ask us.
1. Who we are
Smarch is operated by SMARCH Ideell Förening, Org.nr: 802556-6095, a Swedish nonprofit association — an ideell förening — registered in Stockholm, Sweden ("we", "us", "our").
These Terms and Conditions ("Terms") govern your use of:
- the public website at https://smarch.se,
- the Smarch platform — the application survey, team matching, and team collaboration tools ("the service"), and
- all related features and content.
By creating an account or using the service, you confirm that you have read and agree to these Terms. If you do not agree, please do not use the service.
2. Acceptance and eligibility
2.1 Binding agreement
Creating an account, submitting an application, or using any part of the service forms a legally binding agreement between you and SMARCH Ideell Förening.
2.2 Age requirement
You must be at least 18 years old to use Smarch. By using the service, you confirm that you meet this requirement.
2.3 Capacity
You confirm that you have the legal capacity to enter into this agreement on your own behalf.
3. The service — and its limits
3.1 What Smarch provides
- One structured application — the survey. No CV, no cover letters.
- A queue that prioritises the people who have been searching longest.
- Matching into complementary teams based on skills, motivation and ways of working.
- A structured team programme, paced over roughly six weeks, with weekly deliverables, meetings and staff support.
Free. Permanently. Smarch is a nonprofit. Participation costs nothing, and we never take money from participants — not now, not later.
3.2 What we do not promise
We are honest about the limits of the service:
- We cannot guarantee that you will be matched into a team — matching depends on the queue and on who else is available.
- We cannot guarantee any outcome for a team — a venture, income, or employment. What we promise is a fair queue, honest feedback, and real support.
3.3 Stepping back is always okay
You can pause your availability or leave the programme at any time, without justification. If you are in an active team, tell your team or the staff before you go quiet — stepping back is fine; silence is what harms the team.
4. Your account
- Give us accurate, complete information and keep it up to date. You need a valid email address.
- Keep your login credentials confidential. You are responsible for activity under your account.
- Tell us immediately through the contact form if you suspect unauthorised access.
- One account per person. Duplicate accounts may be suspended or removed.
5. Acceptable use
Use Smarch in compliance with applicable Swedish, EU and international law, these Terms, and our Privacy Policy.
You must not:
- Post false, misleading or fraudulent information, or submit an application on behalf of someone else.
- Upload harmful, offensive, defamatory or discriminatory content.
- Harass, threaten or intimidate other participants, or impersonate any person.
- Attempt unauthorised access to our systems or other users' accounts.
- Scrape, crawl or interact with the service using automated tools or bots.
- Introduce malware or interfere with the operation of the service.
- Reverse engineer or attempt to extract source code from the platform.
- Use the service for spam, phishing, or any unlawful purpose.
We may remove content or suspend accounts that break these rules — see Section 8.
6. Your content — and what teams build
6.1 Your content stays yours
You keep ownership of everything you submit — your survey answers, profile and messages. You give us a limited licence to store, process and display that content as needed to run the service: to our staff, and to your teammates once you are matched.
6.2 What teams build belongs to the team
Smarch claims no ownership of the ideas, projects or companies that teams create. What you build together belongs to the people who build it. How ownership is shared within a team is agreed between team members — we encourage teams to settle this early and in writing.
6.3 Our content
The platform itself — its text, design and code — belongs to Smarch. Please do not copy or reuse it without permission.
7. Changes to the service and these Terms
- The service will evolve, and we may update these Terms as it does.
- Changes are posted on this page with an updated "Last updated" date. Significant changes are announced by email or a notice on the website.
- Continued use of the service after a change means you accept the updated Terms. If you do not agree, stop using the service — you can close your account at any time.
8. Suspension and leaving Smarch
8.1 Leaving is your right
You may close your account whenever you want. Deletion always requires your explicit confirmation, and what happens to your data is described in the Privacy Policy.
8.2 When we may act
We may suspend or terminate accounts that violate these Terms or applicable law. Where reasonably possible, we will explain why and give you a chance to respond.
9. Disclaimers and liability
Smarch is run by a small nonprofit team. The service is provided "as is" and "as available" — we do not warrant uninterrupted availability, error-free operation, or any particular outcome from participation.
To the extent permitted by mandatory law, we are not liable for indirect or consequential damages arising from your use of the service. Nothing in these Terms limits any rights you have under mandatory Swedish or EU consumer protection or data protection law.
10. Governing law
These Terms are governed by Swedish law. Disputes are settled by Swedish courts, without prejudice to any mandatory consumer protections that apply in your EU/EEA country of residence.
